WORKSHOP / SEMINARS
Workshops/seminars are the forum scientists,
researchers and field experts exchange, discuss views and experiences. For
last five years, LERES has been organized many successful seminars with
the subjects following:
Law, policies and measures supporting small
and medium size enterprises of private sector;
Economic dispute resolution and insolvency;
Legal information dissemination – experience of a legal aid networking;
Indigenous norms in relation to Vietnam Civil law.;
Vietnam – US Bilateral Trade Agreement and implementation issues;
Commune budgeting: policy, legal framework and situation;
Law, policies and measures
supporting small and medium size enterprises of private sector.
Small and medium size enterprises of private sector have an important role
in market economy. For many years, Vietnamese Government is trying to
improve legal framework and policies to support and create impetus for
small and medium size enterprises to develop. To organize the exchange for
legal framework and current policies, find out unreasoned points and give
the perfect measures, with the support of the World Bank according to the
small funding program, LERES has organized the workshop on August, 5 and
6th 1999 at Hanoi. This workshop has attracted participation of many
economic experts, some offices of Government, enterprises, legal
researchers, judges, arbitrators as well as lawyers domestic and abroad.
The results of workshop put into the proceedings of conference and being
distributed to the small and medium enterprises at Hanoi.

Economic disputes resolution and
insolvency
The investors always consider carefully when they decide to invest into
the changing and developing economy. Especially, the foreign investors are
quite causious about investment environment. Therefore, the first
importance is to establish a court system to resolve economic disputes
with the reasonable formalities and with the tools to guarantee the
implement of court’s decisions. With the target to impulse the process of
the experiential and information exchange, on October 19th 1999, LERES and
KAS- a German NGO in Hanoi co-coordinated to organize a seminar about “
Economic dispute resolution and enterprise bankruptcy”. The seminar has
happened was successefully conducted with the participation of Mr. Ludger
Kolbeck, the tribunal president of economic court of Bresmen State,
Republican Federation of Germany. At Vietnamese side there were experts,
judges in the domain of economic law of Vietnam, the representation of
People’s Supreme organ of control, research experts at the Departments of
the Ministry of the Justice, Institutes and the international arbitral
Center of Vietnam and the business. The results of seminar has published
as the summary of the conference and being distributed to the Vietnamese
enterprises and jurists.

Legal dissemination – experiences of
a legal aid networking
The legal education and dissemination is interested more and more by Party
and Government. Being a practical application organization of legal
scientific researches, LERES has been undertaking activities to enhance
legal awareness of people. To share experiences with concerned
organizations, at the same time, to learn the experiences of different
countries, this seminar has organized on November 25th 1999. At the
seminar had there were experts working in the areas of legal education and
information dissemination and international experts from Canada, Cambodia,

Indigenous norms in relation to
Vietnam civil law
Being the result of the cooperation
between LERES and Asian Legal research Center of British Colombia
University, Canada. It was the forum to exchange views and experiences
between jurists, historian and practical men (judges, village patriarchs)
at Dak Lak province to research, evaluate the practicability of the
Articles in Civil Code and evaluate the indigenous norms application of
this ethnic minority. (photo).

Vietnam – US Bilateral Trade
Agreement and implementation issues
LERES has co-coordinated with the International Law Department, Law
Faculty, Vietnam National University - Hanoi, to organize a seminar: “
Vietnam - US Bilateral Trade Agreement and Implementation issues” on
April, 17th 2002. The seminar attracted greate concerns of government
agencies (Judicial Ministry, Trade Ministry...), research domestic
organisations and abroad ones, the scientists (Embassy of United State in
Vietnam, the representation of Baker & McKenzie, Hanoi Law University...).
A lots of pratical and theoretical issues were under discussion. With
partially financial support of the public affairs Section of the US
Embassy the proceedings of the Seminar have got pubblished.

Commune budgeting: policies, legal
framework and situation
This workshop was the first step to conduct the experts, the authorities
interesting in Commune budgeting. The essential target of workshop was the
exchange and the introductory of the Commune budgeting through research
papers, viewpoint of the policy form men, financial and budgeting manager.
The initial information’s of policies, legal framework and a part of
situation of Commune budgeting ... gained from workshop that will be the
important data base to the experts of Leres will build a general and
detailed research program on Commune level Public Finance in Vietnam.
The workshop has organized on September 20th 2002 and gained good results.

LERES has high capacity in
conducting research in following areas:

International law, Asean and other foreign country laws.
Research conducted by LERES:
Using indigenous norms in cases under the
Vietnamese Civil Code
This Project commenced in October 1998 and lasted for two years with the
support of SEAFILD – CIDA in collaboration with the Center for Asia Law
Studies of University of British Columbia, Canada. The research on the
indigenous laws and norms aiming at two prominent ethnic minorities, Ede
and M’nong in the Central Highland of Vietnam. Approach taken is based on
Article 14 of the Vietnamese Civil Code with the purpose to research and
report on the ways ethnic minorities in Vietnam may use customary law in
cases that they are being tried under the Civil Code and to examine the
feasibility of stipulations of the Civil Code in reality.
Joint Research Project on
Comparative law
The Law school at Deakin University, Melbourne, Australia, was conducting
a two-year comparative law project mapping the reception of commercial
laws in Malaysia, Indonesia and Vietnam. The purpose of the research
project was to improve understanding of the process of legal adoption in
transition countries. LERES’ work was to assist the Law School to collect
information concerning the drafting of the Civil Code of Vietnam as
specified in the contents of the study.

LEGAL
CONSULTING
Free legal advice for ordinary
people
Every people who come to LERES seeking for
legal advices are not required to present documents demonstrating their
situation of well-being or subject of preferential policies, they are all
helped by legal expert for at least 30 minutes. For the poor, illiterate,
LERES’s staffs help them in drafting letter of complaint, appeal, claim
and assist in searching for related legal documents.
LERES also distributes many legal pamphlets
and legal handbooks free of charge. These pamphlets explain and clarify
legal regulations through common practical cases, in language that is easy
to understand. LERES’ work in this area is an effective contribution to
build up Vietnam as the State ruled by law, to promote good governance and
democracy in Vietnam.

The combination between the flexibility,
enthusiasm of the young and in-depth knowledge, experiences of leading
lawyers/legal experts in Vietnam enables LERES to provide with high
quality legal consulting services in various areas that includes.
